1. INTRODUCTION
Welcome to TrustRating.ai ("TrustRating", "we", "our", or "us"). Our trust intelligence platform allows businesses to engage with consumers, collect feedback, manage business profiles, and gather insights using a hybrid model of automated technology-driven analysis and manual human review. These terms of use govern your access to and use of our website, platform, business accounts, and related services (collectively, the "Services"). By claiming a business profile page, accessing, or using any of our Services, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, you must not access or use our Services.
2. ELIGIBILITY AND ACCOUNTS
You must be at least 18 years old or the legal age of majority in your jurisdiction to form a binding contract to use our Services. When creating or claiming an account on behalf of a business, you represent and warrant that you have the legal authority to bind that entity to these terms. You are entirely responsible for maintaining the security and confidentiality of your account credentials, managing authorized user roles, and for all activities that occur under your business account.
3. PLAN TYPES AND SUBSCRIPTIONS
- Free Plan: By claiming a business profile page, you are granted access to a free business account to utilize standard platform services. This access continues until deleted by you or terminated by us.
- Paid Subscriptions: Subscriptions to premium features run for consecutive 12-month periods unless stated otherwise in your commercial order materials.
- Automatic Renewal: At the end of each subscription period, your plan automatically renews for an identical duration. We reserve the right to adjust renewal pricing by up to 5% annually without prior notification, or a higher percentage provided we offer you 45 days' advance notice.
- Cancellation: To prevent automatic renewal, you must submit a written cancellation request via email to cancellation@trustrating.ai at least 30 days prior to the end of your current subscription period.
4. REVIEW INVITATION SERVICES AND PRIVACY
If you utilize our platform to issue review invitations to consumers, you are legally deemed the sole sender of those communications. You represent and warrant that you have obtained all necessary prior explicit consents, permissions, and rights from your consumers under applicable privacy laws. You agree to strictly abide by our Data Processing Agreement. You are prohibited from uploading or storing Protected Health Information (PHI) or using free-form text fields to store sensitive personal information.
5. TECHNOLOGY-ASSISTED ANALYSIS AND HUMAN OVERSIGHT
TrustRating.ai utilizes automated algorithmic technologies, machine learning, and artificial intelligence models alongside human moderation teams to generate company profiles, trust indicators, summaries, and rating metrics. Automated tools continuously analyze public information, detect fraudulent content, and flag review manipulation patterns. Human reviewers manually evaluate reported concerns, verify flagged behavior, and adjust platform metrics to preserve operational fairness. All generated trust ratings, scores, and evaluations are for general informational purposes only and do not constitute financial, investment, legal, or professional business advice.
6. INTELLECTUAL PROPERTY AND BRAND MARKS
We or our licensors own all legal rights, titles, and interests in the design, look, feel, code, compilation, algorithms, and content of the TrustRating.ai platform, excluding independent user-generated reviews and your corporate assets. You grant us a non-exclusive, worldwide, royalty-free license to display your business name, logos, and visuals across our platform and marketing materials to properly identify your services. You may display TrustRating.ai scores and certified badges on your claimed domains solely in compliance with our official branding guidelines. We reserve the right to revoke your privilege to use our brand marks immediately if misuse is detected.
7. PROHIBITED CONDUCT AND DATA SCRAPING
You agree that you will not, under any circumstances:
- Write, submit, procure, or facilitate fake, biased, or manipulated reviews.
- Impair, disrupt, or undermine the operational security, infrastructure, or integrity of our Services.
- Decompile, reverse engineer, disassemble, or attempt to extract source code from the platform.
- Commit fraud or engage in abusive, harassing, or disrespectful behavior toward our employees, partners, or users.
- Use any automated means, including bots, scrapers, crawlers, or data mining software, to extract text, reviews, or data from our platform for any purpose.
- Utilize any data or content from TrustRating.ai to develop, train, fine-tune, or validate artificial intelligence systems, large language models, or machine learning algorithms without our explicit, advance written consent.
8. TERMINATION AND SUSPENSION
We reserve the absolute right to suspend or terminate your access to your business account, subscription, or our platform immediately and without prior notice if you violate these terms, breach our guidelines, fail to settle outstanding subscription invoices on time, or act in a manner conflicting with our platform's core values. If we terminate your subscription due to your material breach, you remain liable for all unpaid fees through the remainder of the active subscription period, and no refunds or credits will be issued.
9. DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY
Our platform and Services are provided entirely on an "as is" and "as available" basis, without any express or implied warranties of merchantability, non-infringement, accuracy, or fitness for a particular purpose. To the maximum extent permitted by applicable law, TrustRating.ai and its affiliates shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including loss of profits, revenue, goodwill, clients, data, or reputation. Our total aggregate liability to you for any claim arising out of these terms shall be strictly limited to the total amount paid by you to us for the Services in the 12 months immediately preceding the event giving rise to the claim.
10. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless TrustRating.ai, its affiliates, officers, directors, and employees from and against any third-party claims, losses, costs, liabilities, and legal expenses (including reasonable attorney fees) arising out of your use of our Services, the distribution of review invitations, your violation of these terms, or any breach of applicable privacy laws resulting from data you provide.
11. AMENDMENTS TO TERMS AND SERVICES
We reserve the right to modify, amend, or discontinue any aspect of our platform, pricing structures, or these terms at our sole discretion. Non-material changes take effect immediately upon publication. Material changes will be communicated to your account's primary email address whenever feasible. Your continued use of our Services following any modifications constitutes your explicit acceptance of the updated terms.
12. GOVERNING LAW AND JURISDICTION
These Terms and Conditions, along with any disputes or legal claims arising out of or in connection with them, shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to conflict of law principles. You and TrustRating.ai both irrevocably agree that the state and federal courts located in San Francisco, California shall have exclusive jurisdiction to settle any legal dispute, claim, or proceeding.
